Don't Ask, Don't Tell, Don't Engage In Gay Pornography

CNN reports that Army officials are investigating the possibility that members of the 82nd Airborne Division appear on a gay pornography website. Is this the site: Dink Flamingo's ACTIVE DUTY? The agreement you are supposed to read before you enter appears to be the same one referenced in the article.

what do you make of the "legally binding contract" above the ENTER link on the ACTIVE DUTY site? how would "Army officials" suspect the 82nd Airborne, etc., w/o breaking the contract?

i figure it's not the kind of contract that would hold up anyway (adhesion?).

I can't remember the whole adhesion thing well enough to talk about it, especially since I've had 3 beers. But my first thought would be just this: even if they broke a binding contract, what are the damages? If anything, this investigation will help the company. On the other hand, I wonder if Dink Flamingo had some sort of contract with the men who appeared on his site. Perhaps those men will sue the website if they are kicked out of the military. Still, if Dink Flamingo promised them they wouldn't face military consequences, it probably isn't a promise Dink had the power to make anyway. What do they call that?

Also, it is one thing to restrict people under the age of 18 - that is really to protect the website. But can you really tell certain people they can't view your website and then force them to face consequences if they disobey? The WORLD WIDE WEB is sort of like a public street. You can't hold up a sign on the side of the road and say, "If you are an Army Official don't read the rest of this sign ... I'm AWOL," and then sue them when they arrest you for going AWOL.

Also I noticed it says "under penalty of perjury." I think that's nonsense. I think you have to do more than click a button on a website to commit perjury. You usually have to take an oath before a government official or something.
